Section 530
The right to enforce the contract rests only with the party

(1) Only a person who is a party to a contract can demand the performance of such contract from the other party. But if a contract is made for the benefit of a person, such a person can demand compliance even if he is not a party to the contract.
(2) In the case of a joint agreement between two or more persons to do or not to do any work, unless otherwise provided in the contract, all the persons who entered into such an agreement may jointly demand that the agreement be fulfilled.
